TERMS OF SERVICE

Please read these Terms of Service ("Terms") carefully before purchasing or using any services offered by Cultivate Empathy, LLC ("Company," "we," "us," or "our"). By accessing or purchasing any of our services, you ("Client" or "you") agree to be bound by these Terms. If you do not agree, please do not purchase or use our services.
1. Services Offered
Cultivate Empathy, LLC offers the following services, each subject to the specific terms outlined in this agreement:
Coaching Sessions — one-on-one or group empathy and personal development coaching with Candice Heidebrecht
Subscriptions — recurring access to curated content, resources, and community features
Consulting — professional advisory services for individuals or organizations
Self-Paced Courses — pre-recorded digital courses available for individual purchase and ongoing access
2. Important Disclaimer — Not Therapy or Licensed Counseling
Cultivate Empathy, LLC provides coaching, consulting, and educational services only. These services are NOT a substitute for professional mental health treatment, therapy, or licensed counseling.
Candice Heidebrecht is a coach, not a licensed therapist, psychologist, psychiatrist, or medical professional. Nothing shared during coaching sessions, consultations, courses, or any other service constitutes medical advice, mental health treatment, or psychological therapy.
If you are experiencing a mental health crisis or require clinical support, please contact a licensed mental health professional or dial 988 (Suicide & Crisis Lifeline) immediately.
3. Coaching Sessions
3a. Scheduling
Coaching sessions are scheduled through our Calendly booking system at https://calendly.com/candice-heidebrecht. It is your responsibility to book, reschedule, or cancel sessions using the link provided at the time of purchase.
3b. Cancellation & Rescheduling Policy
We understand that life happens. Please observe the following policy:
Cancellations or rescheduling requests made at least 24 hours before your scheduled session will be honored at no charge.
Cancellations made less than 24 hours before your session may result in forfeiture of that session.
No-shows without prior notice will be counted as a used session with no refund or reschedule offered.
Cultivate Empathy, LLC reserves the right to reschedule sessions due to illness, emergency, or unforeseen circumstances, and will provide as much advance notice as possible.
3c. Refund Policy — Coaching Sessions
Refunds for coaching session packages are available only prior to your first session. Once your first session has taken place, all sales are final. To request a refund before your first session, please contact us at the email address listed in Section 10 below.
4. Subscriptions
4a. Billing
Subscription plans are billed on a recurring basis (monthly or annually, as selected at checkout). By enrolling in a subscription, you authorize Cultivate Empathy, LLC to charge your payment method on a recurring basis until you cancel.
4b. Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to subscription content through the end of your paid period. We do not offer prorated refunds for mid-cycle cancellations.
4c. Refund Policy — Subscriptions
Subscription fees are non-refundable once a billing cycle has begun. If you believe you were charged in error, please contact us within 5 business days of the charge and we will review your case.
5. Consulting Services
5a. Scope of Work
Consulting engagements will be defined by a separate agreement or scope of work document agreed upon by both parties prior to the start of any engagement. These Terms apply in addition to any such agreement.
5b. Cancellation & Rescheduling — Consulting
Consulting appointments follow the same cancellation policy as coaching sessions outlined in Section 3b. For multi-session consulting packages, the refund policy in Section 3c applies — refunds are available before the first consulting session only.
6. Self-Paced Courses
6a. Access
Upon purchase, you will receive access to your self-paced course materials as described on the course sales page. Access is granted to you as an individual and may not be shared, transferred, or resold.
6b. Refund Policy — Self-Paced Courses
All self-paced course sales are final. Due to the digital nature of course content, we do not offer refunds once access has been granted. Please review all course descriptions and previews carefully before purchasing.
7. Intellectual Property
All content provided through Cultivate Empathy, LLC services — including but not limited to course materials, worksheets, videos, audio recordings, written content, frameworks, and methodologies — is the exclusive intellectual property of Cultivate Empathy, LLC and is protected by applicable copyright and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use purchased content for your personal, non-commercial use only. You may not:
Copy, reproduce, distribute, or republish any course or coaching materials
Share login credentials or access links with others
Record, screen-capture, or redistribute any live or recorded sessions without written permission
Use our content to create derivative works or competing products or services
Any unauthorized use of our intellectual property may result in immediate termination of your access and legal action.
8. Confidentiality & Privacy
8a. Your Privacy
We are committed to protecting your privacy. Any personal information you share with us — including information disclosed during coaching sessions, consultations, or course interactions — will be kept strictly confidential and will not be shared with third parties except as required by law.
8b. Your Responsibility
If you participate in any group coaching, group courses, or community features, you agree to respect the confidentiality of other participants. Information shared by other participants in a group setting is to be kept confidential and not disclosed outside of that setting.
8c. Exceptions
Confidentiality cannot be maintained in situations where disclosure is required by law, including but not limited to situations involving risk of harm to yourself or others. In such cases, we may be required to disclose relevant information to appropriate authorities.
8d. Data & Communications
By purchasing our services, you consent to receiving transactional and service-related communications from Cultivate Empathy, LLC. You may opt out of marketing communications at any time. Please review our Privacy Policy for full details on how your data is collected, stored, and used.
9. Limitation of Liability
To the fullest extent permitted by California law, Cultivate Empathy, LLC and Candice Heidebrecht shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability to you for any claim shall not exceed the amount you paid for the specific service giving rise to the claim in the three months preceding the claim.
You acknowledge that results from coaching, consulting, or course participation are not guaranteed and depend on your own effort, commitment, and individual circumstances.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
11. Changes to These Terms
Cultivate Empathy, LLC reserves the right to update or modify these Terms at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.
